Your lease agreement with Buckeye Northwest Realty dictates the specific terms for your property, but here is a clear guide to the typical division of labor for snow and ice removal in our communities.

1. The Ohio Legal Standard: The Lease Governs

In Ohio, the responsibility for clearing snow and ice primarily depends on the specific terms outlined in your lease.

     

      • Single-Family Homes: The responsibility for clearing all sidewalks, steps, and driveways usually falls to the Tenant. This is treated as general exterior maintenance, similar to mowing the lawn in the summer.

      • Multi-Unit Complexes (Apartments/Duplexes): The responsibility for Common Areas typically falls to the Landlord/Property Management, as this is considered upkeep for areas used by all residents.

    Crucial Step: Always check the “Maintenance and Repairs” section of your signed lease document to confirm your exact obligations.

    2. The City of Toledo Sidewalk Ordinance and Fines

    Beyond the lease, every resident, whether they are a landlord or a tenant, must comply with the City of Toledo’s public safety ordinances. These rules often place the burden on the occupant of the property.

       

        • The Rule: The occupant of any building is responsible for keeping the sidewalks free from snow and ice.

        • The Timeframe: City law requires residents to remove snow from sidewalks in the public right-of-way within 24 hours after the snow has stopped falling.

        • The Fine: Those who do not comply can be fined $75. Note: If the lease assigns this task to the tenant, the property management may charge the tenant for any fines incurred.

      Buckeye Northwest Realty is committed to keeping common areas safe and accessible. Our policy for snow and ice removal is as follows:

      Pro Tip for Parking Lots: If you would like your individual car spot cleared in a shared lot, feel free to come out and move your car while our maintenance crew is actively clearing the area. This allows us to clear your entire spot effectively.

      4. Safety and Emergency Protocols

      Even if you are not responsible for clearing a certain area, your safety is paramount. We need your help to report critical structural hazards immediately.

         

          • Report Major Ice Build-Up: If you notice severe, damaging ice build-up, such as massive icicles or ice dams on the roof that are causing leaks inside the property, this is a structural emergency. Stop what you are doing and notify property management immediately. Do not attempt to climb onto the roof or knock down the ice yourself.

          • Use Proper Tools: Use a shovel that fits your height and fitness level. If using ice melt, be aware that rock salt severely damages concrete over time by accelerating freeze-thaw cycles, leading to cracking and flaking. For concrete and pet safety, use alternatives that are salt-free and chloride-free, such as those containing urea and glycol blends.
