Tenant Not Maintaining the Yard? What Owners Should Know - Buckeye Northwest Realty

When your lease makes a tenant responsible for yard maintenance, it can be easy to take that responsibility off your plate. But what happens when you notice the work isn't getting done? Here are some steps property owners can take to address the issue before it becomes a bigger problem.

Make Responsibilities Clear

If a tenant will handle yard maintenance, clearly outline those responsibilities in the lease or other applicable rental documents. Be specific about what the tenant is expected to handle, including mowing, leaf cleanup, snow removal, and other exterior upkeep.

Clear expectations matter before you address work the tenant isn’t completing. If the lease does not clearly establish those responsibilities, review its requirements before deciding how to proceed.

Keep Documentation

If yard maintenance becomes an ongoing issue, keep records of what you observe and how you address it. This could include dated photos of the property’s condition and copies of relevant communication with the tenant.

Documentation should focus on the condition you’re addressing. If checking the property requires access to the rental, follow the lease and applicable notice requirements.

Communicate With Your Tenant

If the work isn’t getting done, communication is a good place to start. Let the tenant know what you’ve noticed and reference the responsibilities outlined in your rental documents.

It may also be worth asking whether something is preventing them from completing the work. A tenant may not have the necessary equipment or may need assistance handling the physical work. Depending on the situation, you may be able to point them toward local resources.

In some situations, an owner and tenant may agree to arrange a paid maintenance service. Clearly discuss any costs or changes in responsibility with the tenant. Make sure the arrangement follows the lease and applicable law.

What to Know About City Notices

In Toledo, certain nuisance conditions, including tall grass, weeds, junk, or debris, can result in a 72-hour notice to correct the problem. Notices may be posted directly at the property, so owners may not always learn about an issue the same way.

If the problem is not corrected, the City may take additional action, which can include completing the work and assessing associated costs against the property. If you become aware of a City notice, pay attention to the instructions and deadlines provided.

Staying Involved

Assigning yard maintenance to a tenant does not mean an owner should stop paying attention to the property’s exterior. Clear lease terms and consistent communication can help you address small maintenance issues before they become larger problems.

For owners who live outside the area, staying aware of a property’s condition can be more difficult. Working with a local property management company gives you someone nearby to help oversee the property. They can also communicate with tenants and address maintenance concerns as they come up.
