No Comments on Breaking a Lease Early in Ohio: What Renters Should Know
Need to move before your lease ends? Whatever the reason for your move, there are a few things you'll want to understand before leaving your rental. Here's what Ohio renters should know.
Start by Reviewing Your Lease
Your lease is the first place to look if you need to move before your rental term ends. Some leases explain what happens if you leave early, including how much notice you need to give and whether any fees apply.
Look for sections about ending your lease, moving out early, or having someone else take over your rental agreement.
If your lease doesn’t mention early termination, that doesn’t automatically mean you can leave without additional costs.
Talk to Your Landlord About Your Situation
If you need to leave early, contact your landlord or property manager as soon as possible. Explain your situation and ask what options are available.
Keep in mind that moving out doesn’t automatically end your lease. Even after you’ve left the property, you could still be responsible for rent or other costs unless you’ve legally ended the agreement or worked out another arrangement with your landlord.
Understand Early Termination Fees and Other Costs
An early termination fee is a charge for ending your lease before the agreed-upon end date. Whether your landlord can enforce that fee depends on your lease and Ohio law.
Even if your lease doesn’t include an early termination fee, you could still owe unpaid rent or other costs related to leaving early.
Ohio landlords also have a legal responsibility to make reasonable efforts to limit their losses when a tenant breaks a lease. This means taking reasonable steps to find another renter rather than leaving the property vacant and continuing to charge the previous tenant.
What If Your Lease Doesn’t Mention Early Termination?
If your lease doesn’t explain what happens when you break it early, your landlord can’t simply make up a penalty for leaving. You could still owe rent or other costs, but those charges must have a valid basis under your lease or Ohio law.
That doesn’t mean you’re free from your existing obligations. You may still owe rent or other costs you’re legally responsible for, depending on the circumstances.
You and your landlord can also agree on new terms to end the lease. Before accepting a proposed fee or arrangement, ask for the details in writing so you understand exactly what you’re agreeing to.
When Can You Legally End a Lease Early?
Certain circumstances may give Ohio renters the right to end a lease before its scheduled expiration date.
For example, the federal Servicemembers Civil Relief Act (SCRA) provides early termination protections for qualifying military servicemembers. These protections apply in certain situations involving military service, deployment, or relocation orders.
Ohio law also provides remedies when landlords fail to meet certain legal obligations. In qualifying situations, tenants may have the right to terminate their rental agreement after following specific notice and procedural requirements.
These protections don’t apply automatically in every situation. If you believe you qualify, review the requirements before moving out or stopping rent payments.
Get Any Agreements in Writing
If you and your landlord agree to end the lease early, make sure the terms are documented.
A written agreement should clarify the termination date, any payments owed, and the expectations for returning keys and leaving the property.
Keep copies of your communications, payment records, and move-out documentation. Having everything in writing can help prevent misunderstandings after you’ve left.
